Terms of Service

Agreement to Terms

By accessing or using CLEC.live ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

These terms are governed by and construed in accordance with the laws of Switzerland, with consideration for European Union regulations where applicable.

1. Description of Service

CLEC.live is a platform that facilitates collaboration between event organizers, artists, venues, and contributors to create live events. We also enable audiences to discover and engage with these events.

The Platform provides tools for event planning, collaboration management, and community building within the live events industry.

2. Beta Service Disclaimer

The Platform is currently in beta testing phase. By using the Platform, you acknowledge and agree that:

• Feel free to use the platform free of charge during the beta period
• The Platform may contain bugs, errors, or incomplete features
• Service interruptions may occur without prior notice
• Features may change, be modified, or removed at our discretion
• Data loss, while we work to prevent it, may occur

We encourage users to report any bugs or provide feedback to help us improve the Platform at feedback@clec.live.

3. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities under your account

You may create multiple profile types (Artist, Venue, Contributor, Audience) within a single account as permitted by the Platform.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Harass, abuse, or harm other users
• Post false, misleading, or fraudulent content
• Infringe on intellectual property rights of others
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Use automated systems to access the Platform without permission
• Engage in spam or unsolicited communications

5. User Content

You retain ownership of content you create on the Platform. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for the purpose of operating and promoting the Platform.

You are responsible for ensuring you have the necessary rights to any content you post, including music, images, and text.

6. Event Collaborations

CLEC.live facilitates connections between event collaborators but is not a party to any agreements made between users. Users are responsible for:

• Negotiating and fulfilling collaboration agreements
• Ensuring compliance with local laws and regulations for events
• Obtaining necessary permits, licenses, and insurance
• Honoring commitments made to other collaborators

7. Limitation of Liability

To the maximum extent permitted by applicable law (including EU consumer protection laws and Swiss law):

• The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not responsible for disputes between users or the outcomes of event collaborations
• During the beta period, we specifically disclaim liability for service interruptions, data loss, or feature unavailability

Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud or personal injury caused by negligence.

8. Indemnification

You agree to indemnify and hold harmless CLEC.live and its operators from any claims, damages, or expenses arising from your use of the Platform, your violation of these terms, or your violation of any rights of third parties.

9. Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our discretion.

Upon termination, your right to use the Platform ceases immediately, though certain provisions of these terms (such as limitation of liability) will survive termination.

10. Changes to Terms

We may modify these terms at any time. We will notify users of significant changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the modified terms.

11. Governing Law and Disputes

These terms are governed by Swiss law. For users residing in the EU, mandatory consumer protection laws of your country of residence will apply where they offer greater protection.

Any disputes will be resolved through the competent courts in Switzerland, without prejudice to your right to bring proceedings in the courts of your country of residence if you are an EU consumer.
